Terms and Conditions

These Terms govern your access to and use of Kootami web properties, mobile and web application interfaces, tenant portals, public forms, event registration modules, payment-linked workflows, and related support services.

By continuing to use the platform, you agree to these Terms, ourPrivacy Policy, ourDPDP Compliance Notice, and ourCookie Policy.

1. Acceptance and Scope

These Terms apply to all users including administrators, staff, members, invited participants, vendors, and public registrants interacting with any Kootami-managed experience.

2. Definitions

  • Organization/Tenant: Any institution using Kootami as a managed workspace.
  • User: Any natural person using or accessing the service.
  • Platform Data: Data created, uploaded, processed, or exported through Kootami.
  • Public Form: Any share-token-based or event-linked form exposed without login.

3. Eligibility and Authority

You must have legal capacity to enter binding obligations. If you use Kootami on behalf of an organization, you represent and warrant that you are authorized to act for that organization.

4. Account Registration and Security

  • Provide true, complete, and updated profile and organization information.
  • Protect credentials, devices, and session access from unauthorized use.
  • Immediately report suspected unauthorized access, fraud, or credential compromise.
  • Use strong passwords and follow security controls enabled by your organization.

5. Organization Governance Responsibilities

Each organization is responsible for lawful operation of its tenant, including:

  • Role assignment, admin delegation, and workflow approvals.
  • Accuracy of membership plans, event policies, and payment terms shown to users.
  • Obtaining valid notices/consents and regulatory approvals where required.
  • Compliance with local legal obligations applicable to its activities.

6. Acceptable Use and Prohibited Conduct

You may not use the platform to:

  • Violate law, regulation, sanctions requirement, or third-party rights.
  • Upload malware, conduct vulnerability abuse, scrape protected data, or bypass controls.
  • Submit fraudulent membership, event, payment, or identity information.
  • Transmit abusive, unlawful, or rights-infringing content.
  • Interfere with platform availability, reliability, or integrity.

7. Membership, Events, and Payments

  • Membership eligibility, approval, and benefits are controlled by each organization.
  • Event approval, waitlist, and participation rules are organizer-configured.
  • Pricing, taxes, refunds, and reversals may vary by tenant policy.
  • Payment processing may involve external providers and banking networks.
  • Kootami is not responsible for organization-specific policy disputes between users and organizations.

8. Public Form and Tokenized Access Terms

Share-token-based form links are intended for legitimate submission flows. You may not brute-force, enumerate, or automate token probing, and you may not use public form endpoints for abuse or spam.

9. Platform Changes, Availability, and Maintenance

We may add, modify, or retire features for security, legal, or operational reasons. Scheduled maintenance, emergency interventions, and protective throttling may affect temporary availability.

10. Intellectual Property and License

Kootami and its licensors retain all rights to platform software, architecture, branding, and documentation. Subject to compliance with these Terms, users receive a limited, non-transferable, revocable right to use the service.

11. Data Ownership, Privacy, and Confidentiality

  • Organizations retain ownership of their tenant data and content.
  • Kootami processes data to provide services, security controls, and support operations.
  • Privacy practices are detailed in the Privacy Policy.
  • We do not sell personal data.

12. Security, Auditability, and Compliance Cooperation

Kootami maintains administrative, technical, and operational controls to protect platform operations. Users and organizations must cooperate with reasonable security controls, incident triage, and compliance investigations.

13. Third-Party Services

Certain functions rely on third-party infrastructure and integrations. Their products are governed by their own terms and privacy notices in addition to these Terms.

14. Suspension, Restriction, and Termination

We may suspend or terminate access for material breaches, abuse, fraud, legal risk, or security risk. Accounts may also be restricted while suspected compromise is investigated.

15. Warranty Disclaimer

Except where expressly stated in writing, the service is provided “as is” and “as available.” To the extent permitted by law, all implied warranties are disclaimed.

16. Limitation of Liability

To the maximum extent permitted by law, Kootami is not liable for indirect, incidental, consequential, special, or punitive damages. Aggregate liability is limited to fees paid for the relevant service in the twelve months preceding the claim.

17. Indemnity

You agree to indemnify and hold harmless Kootami and affiliated entities from claims arising from your misuse of the platform, legal violations, or breach of these Terms.

19. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Subject to applicable mandatory consumer protections, courts at Hyderabad, Telangana, India shall have exclusive jurisdiction over disputes.

20. Amendments

We may revise these Terms for legal, security, operational, or product reasons. Material updates will be reflected through revised effective dates and published notices.
